Privacy Policy

1. Who we are

ClientCheck is an AML/CTF compliance software platform operated by ClientCheck Pty Ltd (ABN to be updated). We provide tools to help Australian accounting and legal practices meet their obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

Our platform is available at clientcheck.com.au and app.clientcheck.com.au.

2. What information we collect

We collect the following categories of information:

Account information: Name, email address, practice name, practice type, ABN, and billing details when you sign up for ClientCheck.

Usage data: How you use the platform, including pages visited, features used, and actions taken within the app. This is collected via analytics tools and application logs.

Client data: Information about your clients that you enter into ClientCheck as part of your AML/CTF compliance program — including identity documents, risk assessments, and transaction records. You control this data. We process it on your behalf.

Communications: Messages you send us via email or the contact form.

3. How we use your information

We use your information to:

- Provide and maintain the ClientCheck service - Process your subscription and billing - Send you service-related communications (account notices, feature updates, security alerts) - Respond to support requests - Improve the platform based on usage patterns - Meet our own legal and regulatory obligations

We do not sell your information to third parties. We do not use your client data for any purpose other than providing the service.

4. How we store and protect your information

All data is stored in Australia (Sydney region, ap-southeast-2). Your client data does not leave Australia.

We use encryption in transit (TLS) and encryption at rest for all stored data. Access to production systems is restricted to authorised personnel only.

We retain your data for the duration of your subscription. After cancellation, your data is retained for 90 days and then archived. Compliance records are retained for 7 years as required by AUSTRAC, even after account cancellation.

5. When we disclose your information

We may disclose your information in the following circumstances:

Legal requirements: If required by law, court order, or a lawful request from a government agency.

AUSTRAC obligations: We may be required to report certain information to AUSTRAC under the AML/CTF Act.

Service providers: We use a small number of third-party service providers to help us deliver ClientCheck (such as cloud infrastructure providers and payment processors). These providers are contractually bound to protect your information and may only use it to provide services to us.

Business transfers: If ClientCheck is acquired or merges with another entity, your information may be transferred as part of that transaction. We will notify affected users in advance.

We will not disclose your information for marketing or advertising purposes.

6. Your rights

Under the Australian Privacy Principles (APPs), you have the right to:

Access the personal information we hold about you. Request correction of information that is incorrect or out of date. Lodge a complaint if you believe we have breached the APPs.

If you are unhappy with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

7. Client data — important note

ClientCheck processes AML/CTF compliance data on behalf of your practice. In legal terms, your practice is the data controller for your client data — ClientCheck is a data processor.

Your practice has its own obligations to your clients under the Australian Privacy Principles. These obligations exist independently of ClientCheck's privacy policy. You should ensure your practice's own privacy policy reflects how you collect and handle client information as part of your AML/CTF compliance program.

8. Cookies and analytics

The ClientCheck marketing site (clientcheck.com.au) uses Google Analytics 4 to measure traffic and usage. This may involve cookies. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.

The ClientCheck application (app.clientcheck.com.au) does not use third-party analytics cookies.

9. Changes to this policy

We may update this privacy policy from time to time. We will notify you of material changes by email or by a notice in the application. The date at the bottom of this page shows when the policy was last updated.

Continued use of ClientCheck after changes are posted constitutes acceptance of the updated policy.
